SOLID HOOK INC. – TERMS & CONDITIONS

These Terms & Conditions govern all services provided by Solid Hook Inc. (“Solid Hook,” “we,” “our,” or “us”). By requesting, approving, or receiving any service from Solid Hook Inc., including machinery moving, rigging, millwrighting, equipment installation, transportation, decommissioning, staging, storage, crating, and export packaging, you (“the Client”) agree to these Terms.

  1. Quotations and Pricing
    1.1 Quotes are estimates unless explicitly stated as Fixed Price. Pricing may change if site conditions differ, equipment information is inaccurate, or additional work is requested onsite.
    1.2 Fixed Price quotes include a built-in buffer. This protects you from unexpected increases but may cost more than paying actual daily rates.
    1.3 Pricing excludes HST, permits, engineering, fencing removal, electrical or gas work, parking, environmental fees, disposal fees, and third-party charges unless otherwise stated.
    1.4 Daily rates are based on up to 10 hours. Overtime, weekend, and night work are billed at higher rates.
  2. Client Responsibilities
    2.1 The Client must ensure all information provided (weights, dimensions, photos, drawings, access details, utilities, hazards, and floor ratings) is accurate.
    2.2 The Client must ensure proper access, clear pathways, safe working areas, adequate lighting, and structural suitability for heavy equipment. Snow and ice must be cleared in winter.
    2.3 The Client is responsible for ensuring equipment is properly disconnected by qualified personnel unless Solid Hook has agreed to provide a turnkey service.
  3. Scheduling and Delays
    3.1 Scheduled dates may change due to weather, equipment availability, or delays caused by third parties.
    3.2 Delays not caused by Solid Hook may result in additional charges, including waiting time, idle time, or remobilization.
    3.3 If trucks, forklifts, or crews arrive and cannot perform the work, minimum charges will apply.
  4. Safety and Compliance
    4.1 Solid Hook reserves the right to stop work if conditions are unsafe or unsuitable.
    4.2 Additional safety requirements such as barricades, spotters, or specialized equipment may be billed if not included in the quote.
    4.3 The Client agrees not to interfere with work operations.
  5. Equipment Condition and Risk
    5.1 Machinery older than 15 years or not maintained properly may require extra labour and precautions.
    5.2 Solid Hook is not responsible for internal component failures, pre-existing damage, fragile parts, glass, covers, loose items, or hidden defects.
    5.3 All loads are moved at the Client’s risk unless otherwise agreed in writing.
  6. Storage, Crating, and Export
    6.1 Storage is billed monthly in advance; partial months are not prorated.
    6.2 Crating and export work is based on disclosed dimensions and may be adjusted if actual sizes differ.
    6.3 Solid Hook is not responsible for customs delays, inspections, or handling by third-party logistics providers.
  7. Disposal and Environmental Fees
    7.1 Disposal pricing is based on estimated weights; actual disposal invoices may be passed through.
    7.2 Hazardous materials, oils, and fluids must be declared. Environmental charges may apply.
  8. Terms of Payment
    8.1 Payment is due on receipt unless otherwise agreed in writing.
    8.2 Any overdue amounts will accrue interest at the Legal Rate, defined as the interest rate permitted under the Courts of Justice Act (Ontario), calculated from the invoice due date until paid in full.
    8.3 If additional administrative, legal, or collection costs arise from late or unpaid balances, the Client is responsible for those costs as allowed under Ontario law.
    8.4 Deposits or progress payments may be required for large projects.
    8.5 Solid Hook Inc. may pause work, delay delivery, or withhold equipment or materials if payments are not made according to the agreed terms.
  9. Liability Limitations
    9.1 Solid Hook’s liability is limited to the value of the service fees paid, not exceeding 25,000 dollars, unless separate insurance coverage was arranged in writing.
    9.2 Solid Hook is not liable for downtime, production loss, indirect damages, floor or structural failures, hidden issues, or inaccurate information provided by the Client.
    9.3 Specialty equipment such as CNC machines, lasers, presses, robotics, medical devices, and NMR magnets may require additional insurance at the Client’s expense.
  10. Ownership, Access, and Permissions
    10.1 The Client confirms they have legal authority to move, remove, or dispose of equipment.
    10.2 Solid Hook may request written authorization before work begins.
    10.3 The Client must arrange access to buildings, docks, elevators, and shipping doors.
  11. Cancellations
    11.1 Cancellations within 48 hours of the scheduled date may result in mobilization charges, crew minimums, and equipment rental fees.
    11.2 Deposits are non-refundable for fabricated items such as crates, skids, or custom bracing.
  12. Photos and Documentation
    12.1 Solid Hook may document work with photos or videos for safety, insurance, and operational records.
    12.2 These may be used for marketing unless the Client requests otherwise in writing before the job begins.
  13. Governing Law
    These Terms are governed by the laws of the Province of Ontario.
  14. Acceptance
    By hiring Solid Hook Inc. or allowing our crew onsite, the Client acknowledges and accepts these Terms and Conditions.
