SOLID HOOK INC. – SERVICE LIABILITY DISCLAIMER

The following disclaimer applies to all services provided by Solid Hook Inc. (“we,” “our,” or “us”), including machinery moving, industrial rigging, millwrighting, plant relocations, equipment installation, decommissioning, transportation, staging, storage, crating, and export packaging. By engaging Solid Hook Inc., the client (“you” or “your”) agrees to the terms below.
Information Provided by the Client
You are responsible for ensuring all information provided to us is accurate, including equipment weight, dimensions, center of gravity, photos, site conditions, floor layouts, door measurements, ceiling heights, pathways, and access requirements. You are also responsible for confirming that all utilities have been properly disconnected unless turnkey service is included in the agreement. Solid Hook Inc. is not liable for delays, safety issues, or additional costs resulting from inaccurate or incomplete information. Any discrepancies may result in modified pricing or cancellation of work.
Site Conditions and Preparation
Unless otherwise agreed in writing, the client must ensure that all pathways and work areas are clear and safe before the crew arrives. This includes removing obstacles, doors, railings, machinery guards, overhead obstructions, and ensuring adequate lighting. Floors must be rated for the equipment being moved, and outdoor surfaces must be suitable for heavy equipment. Snow and ice must be cleared in winter. We reserve the right to refuse service if conditions are unsafe or unsuitable. Additional charges may apply for delays or onsite corrections.
Utility, Mechanical, and Electrical Work (Turnkey Services)
Solid Hook Inc. can provide full turnkey support, including electrical, mechanical, plumbing, and utility-related work, only when these services are explicitly included in the written quote, contract, or project scope. When turnkey service is part of the job, Solid Hook may coordinate or supply qualified subcontractors, licensed tradespeople, and certified technicians for tasks such as electrical disconnection and reconnection, gas, water, air, and hydraulic line work, machine leveling, anchoring, alignment, and mechanical installation. All such work is performed in accordance with local laws and regulations using licensed professionals where required.
If turnkey service is not included in the agreement, the client is responsible for arranging all required licensed trades. Solid Hook Inc. is not responsible for utility or mechanical work performed by others, nor for delays or damage resulting from incomplete or improper disconnections.
Equipment, Machinery, and Facility Risks
Machinery moving and rigging involve inherent risks. Solid Hook Inc. is not liable for pre-existing damage, wear, hidden defects, internal mechanical or electrical issues, rust, structural weaknesses, or damage caused by prior repairs or improper maintenance. We are not responsible for damage caused by customer-supplied equipment such as forklifts, cranes, or skates. We are not responsible for cosmetic scratches, paint wear, or minor contact marks on older or previously used equipment. We are also not responsible for loss of production, business interruption, or other consequential damages.
Delays and Waiting Time
Additional charges may apply for delays caused by inaccessible locations, incorrect scheduling information, lack of onsite personnel, incomplete site preparation, additional work not included in the quote, weather conditions, or any situation outside our control. Quotes are based on efficient, uninterrupted workflow. Waiting time may be billed at hourly rates.
Transportation and Loading
Solid Hook Inc. is not liable for internal damage to equipment that cannot be observed externally or for shifting of internal components due to age, condition, or prior modifications. We are not responsible for issues related to inadequate or customer-provided packaging. Transportation is performed according to industry best practices, but certain risks are unavoidable due to equipment weight, age, and design.
Insurance and Liability Limits
Solid Hook Inc. maintains WSIB coverage and commercial liability insurance. Our maximum liability is limited to the amount charged for the specific service provided, unless otherwise stated in a written agreement. We do not cover loss of inventory, product, raw materials, perishables, downtime, lost revenue, or any incidental or consequential damages.
Additional or Unplanned Work
Any task not explicitly listed in the quote or scope of work is considered additional work and may incur extra charges. This includes unexpected disassembly, cutting, fabrication, welding, additional rigging equipment, extra crew, extended hours, or weekend or overtime work. Whenever possible, we will notify the client before proceeding with additional work.
Acceptance of Terms
By hiring Solid Hook Inc., receiving a quote, paying a deposit, or allowing work to begin, the client acknowledges and agrees to the terms outlined in this Service Liability Disclaimer. These terms apply to all projects unless explicitly overridden by a written agreement signed by both parties.
